Welcome to the Building Skills NY (“BSNY,” “we,” “our,” or “us”) website. By accessing or using this website, you agree to these Terms of Use. These Terms constitute a legally binding agreement between you and Building Skills NY. If you do not agree to these Terms, you are not authorized to access or use the website and must exit the website immediately.  

We may update these Terms periodically, and continued use of the website constitutes acceptance of any changes.  

1. Purpose of the Website 

Building Skills NY is a nonprofit workforce intermediary that connects job seekers, employers, training providers, and industry partners. Information provided on this website is for general informational and workforce-development purposes only. 

2. No Employment Guarantee 

BSNY supports workforce opportunities that abide by BSNY’s terms of use and other conditions where applicable.  BSNY is not the employer of any job seeker using the Website and does not become an employer, joint employer, staffing agency, or agent of any employer by virtue of providing referrals, job postings, training opportunities, or related services.  All hiring, screening, interviewing, compensation, supervision, promotion, discipline, and termination decisions are made solely by participating employers.  BSNY does not guarantee: 

  • Employment, job placement, interviews, or job offers; 
  • The availability, suitability, or continued existence of any position; 
  • Any minimum wage or compensation level; nor 
  • The qualifications, performance, or conduct of any employer, job seeker, contractor, or third party. 

Website users accept and acknowledge that hiring decisions are made solely by employers – not BSNY – and employment decisions remain the responsibility of those parties involved. 

3. Equal Employment Opportunity Statement 

BSNY supports equal employment opportunity and does not knowingly facilitate discriminatory employment practices.  Employers utilizing the Website and/or BSNY services are expected to comply with all applicable federal, state, and local anti-discrimination laws. 

4. Acceptable Use 

You agree to use this website only for lawful purposes. You may not: 

  • Impersonate another person; 
  • Use another person’s name or address without authorization; 
  • Violate any applicable law or regulation; 
  • Submit false, misleading, or fraudulent information; 
  • Attempt to gain unauthorized access to the website or its systems; 
  • Introduce viruses, malicious code, or other harmful technology; 
  • Use the website in a manner that interferes with its operation or the use of the website by others.  
  • Use automated tools, bots, scraping technologies, or similar methods to access, monitor, collect, or copy content or information from the website without our prior written consent; 
  • Send unsolicited communications, spam, or other disruptive or unauthorized electronic messages through the website or using information obtained from the website. 

We reserve the right to restrict or terminate access to the website for any user who violates these Terms. 

5. Intellectual Property 

All website content, including text, graphics, logos, videos, publications, and other materials, is owned by or licensed to BSNY and is protected by applicable intellectual property laws. You may view, download, and print content for personal, non-commercial use, provided that all copyright and proprietary notices remain intact. Any other use requires prior written permission from BSNY.  

6. User Submissions 

Any information you provide through forms, applications, registrations, or other website features must be accurate and current. By submitting information through the website, you grant BSNY a non-exclusive, royalty-free, license to use, reproduce, store, distribute, and display such content as reasonably necessary to operate the website and provide services. 

6A. Social Media and User Content 

Any comments, posts, or other content submitted to BSNY social media channels or interactive website features must comply with these Terms and all applicable laws. BSNY reserves the right, but not the obligation, to remove content that is unlawful, misleading, offensive, infringing, or otherwise inconsistent with its mission or policies. 

7. Third-Party Links and Resources 

This website may contain links to third-party websites, job postings, training providers, or other resources. These links are provided for convenience only. BSNY does not endorse and is not responsible for the content, accuracy, availability, or practices of third-party websites or services. Accessing third-party resources is at your own risk.  

8. Disclaimer of Warranties 

This website and all content are provided on an “as is” and “as available” basis. BSNY makes no warranties, express or implied, regarding the accuracy, completeness, reliability, availability, or suitability of the website or its content. We do not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components. 

9. Limitation of Liability 

To the fullest extent permitted by law, BSNY, its officers, directors, employees, partners, and agents will not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or relating to your use of, or inability to use, the website or reliance on information available through the website.  

10. Privacy Policy 

Your use of the Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. 

10A. Communications and Email Privacy 

Communications transmitted over the internet, including email and SMS, may not be secure and should not be considered confidential. You should not send sensitive or proprietary information through the website or by email unless appropriate security measures are in place. 

11. Collecting and Processing User Communication Data 

BSNY Collects and Processes Communication Data: By using the Site, you agree that BSNY collects, records, processes, analyzes, and stores (including via automated means) all your activities, interactions, and communications on or through the Site. This includes visited URLs, viewed content, input info, clicks, scrolls, hovers, and time spent. This data about your activities on or through the Site is used for analysis, quality control, policy enforcement, content moderation, and to improve the Site. BSNY uses vendors as an extension of the Site to collect, record, process, analyze, and store this data. You authorize BSNY to use this data to develop and train AI/machine learning models, without compensation. If you disagree with any part of these terms, do not use the Site. 

12. Governing Law 

These Terms are governed by the laws of the State of New York and Federal Law without regard to conflict-of-law principles. Any dispute arising from these Terms or the use of this website shall be brought in a court of competent jurisdiction located in New York City, New York. 

This website and related services are operated from New York, United States, and are intended solely for persons located within the United States. 

Unless expressly stated otherwise, we do not intend to subject ourselves to the laws of any foreign jurisdiction, including the GDPR, nor do we direct our activities toward residents of the European Union, European Economic Area, United Kingdom, or Switzerland. 

By using this website, you represent that you are accessing the website from a jurisdiction in which our services are offered and that you are not seeking services that we do not make available in California. Based on our current activities and organizational structure, we believe the California Consumer Privacy Act (“CCPA”), as amended, does not apply to our organization. 

13. Security, Viruses, and Malware 

BSNY encourages users to maintain appropriate security measures and antivirus protections when accessing the internet and downloading materials. 

While BSNY takes reasonable measures to maintain the security of the website, we do not guarantee that the website, servers, files, or communications are free from viruses, malware, harmful code, or other security threats. BSNY shall not be responsible for any loss, damage, or disruption caused by such threats.
